{"id":304,"date":"2007-02-02T06:44:11","date_gmt":"2007-02-02T11:44:11","guid":{"rendered":"http:\/\/www.citizennetmom.com\/?p=304"},"modified":"2007-02-02T06:55:55","modified_gmt":"2007-02-02T11:55:55","slug":"new-standard-of-guilt","status":"publish","type":"post","link":"https:\/\/www.citizennetmom.com\/?p=304","title":{"rendered":"New Standard of Guilt"},"content":{"rendered":"<p><a title=\"Hobbs on HB0136\" target=\"_blank\" href=\"http:\/\/billhobbs.com\/2007\/02\/an_assualt_on_web_writers.html\">Bill Hobbs<\/a> seems to have been the first to pick up on <a title=\"HB0136\" target=\"_blank\" href=\"http:\/\/www.legislature.state.tn.us\/bills\/currentga\/BILL\/HB0136.pdf\">HB0136<\/a>, which would introduce a whole new (non) standard of guilt for bloggers and website owners in the area of libel.<\/p>\n<blockquote><p>Tennessee State Rep. <a href=\"http:\/\/www.legislature.state.tn.us\/house\/members\/h52.htm\"><strong>Rob Briley<\/strong><\/a> has filed legislation that could, if it becomes law, require bloggers and other website publishers and writers to remove within two days from their website <strong>any statement that someone alleges is defamatory &#8211; and if they fail to remove the statement within two days that failure will &#8220;create a presumption of malice intent.&#8221;<\/strong> The contested statement <u>does not actually have to be defamatory<\/u> for the web writer to be required to remove it or face that legal presumption of guilt.<\/p><\/blockquote>\n<p>Briley filed it by mistake, but it was actually Sen. Jamie Woodson (R-Knoxville) who thought this up, asking Briley to carry it in the House.<\/p>\n<p>The <a title=\"City Paper: HB0130\" target=\"_blank\" href=\"http:\/\/www.nashvillecitypaper.com\/index.cfm?section=9&#038;screen=news&#038;news_id=54427\">City Paper<\/a> has a good summary this morning; <a title=\"Kleinheider: HB0130\" target=\"_blank\" href=\"http:\/\/www.news2wkrn.com\/vv\/2007\/02\/jamie_woodson_handed_off_withd.html\">Kleinheider<\/a> has a wrap up as well.<\/p>\n<p>&#8211;  &#8211;  &#8211;<\/p>\n<p>Briley and Woodson are both lawyers; in my view, they should know better than to think up something with such a flimsy standard of proof as the mere fact that someone doesn&#8217;t like what is said about them.<\/p>\n<p>Briley says that he&#8217;ll withdraw as sponsor today.
